What is the name of your state (only U.S. law)? PA
I loaned my niece several small loans over several years. She stopped paying me the monthly payments in mid 2007. I sent a letter of demand giving 10 days to pay up but she has ignored it. The magistrate's office gave me a civil suit form but it says I have to cite the statute under which I'm filing the action. I went to my local law library and looked up the PA statutes but many pages are torn out and I couldn't find what I needed to cite. I DO have a note signed saying agrees to pay monthly!
Also, her brother was in jail for non-payment of child support. His dad (my brother-in-law) cried to me (literally) each time he visited his son and asked me if I could loan him the bail money. At first I didn't have it but later on I got an insurance settlement that the Bro-in-law knew about and he again cried about it killing him that son was in jail. I said I'll loan the son the money but need to be paid back.
Son gets out of jail, starts paying then stops and says he didn't ask to be freed by my money and won't pay anymore. This is the brother of the niece I spoke about above. Two dead beats! Father says too bad, that's between me and his kids. I didn not have the nephew sign an IOU but since he started to pay I figure that admits that he owed the money. I wrote a check to the niece and she took it to the bank, They called my credit union to verify that the check was good otherwise it would taks so many days to clear.
She was given the cash (demanded by the legal system - no checks) and took it to wherever she needed to to bail him out. She signed the check which says on the back that it's a loan to be paid back asap and she signed under it. I sent both of them a demand for payment for this debt and like the nieces debt, they ignored it. I sent both of them the same notice since she took the check, cashed it and bailed him out and he acknowledged he owed it (in my opinion) by making some payments.
Again I need to know the statute under which I say I'm suing. I searched the internet and this site but cannot find my answer and the law library people say oops, someone must have ripped out the pages and they cannot give me legal info!
Can anyone guide me to where I can find the statute(s) I need. They had until June 20th to pay under the 10 day demand and I got the civil form right after that and have been searching for the statute(s) since (about 1 month now).
I know I should have gotten a signed note from the nephew but he never came to my house after he got out of jail and gave the payments to his dad or his sister. Hindsight is 20- 20! That's what I get for helping out relatives, I learned not to rent to relatives many years ago but am a sucker for relatives sob stories. My husband (it's his family) said I shouldn't make the loans but I went against his wishes so I'm eating crow now!
