I have brought a contempt of a court order action against my ex, again. In May, we had a trial and the judge suspended the sentence providing he pays current and back support. My ex is a commercial fisherman, and is captain of a boat. His employer (the boat owner) either isn't garnishing his wages and/or is not sending in the garnished wages to OSE. I am due to go back to court, and want to supeona his employer and the financial records for my ex's work. Can someone tell me how to go about this?
also, can I bring charges against the employer for either not garnishing or not sending in garnished wages to ose? My ex has a court appointed atty, I am representing myself...as I cannot afford an atty. Also, can I protest the fact that he told the court he was indigent, and was given a free lawyer to defend the criminal charge? He provided proof in the end of July that he sold over $9,000 worth of tuna after a 5 day trip. He makes alot of money, but claims to the court and OSE that he has not made any, and that is why I want his employers records brought into court. I know for a fact that he has been fishing since March on this same boat.

I don't think you could get the employer supbeaoned. But the judge can. Explain this to him when you go in for the contempt hearing.

Go to the court and ask the clerk for the form to complete for a Subpoena Duces Tecum. In it you will list the ex's employer and 'any and all employee pay stubs, timesheets, records of payments to OSE and proof of garnishment.'
