What is the name of your state (only U.S. law)? CA

Long story short...I've been a Union Member since 1991 and a Union Contractor since 2003. Do to my ignorance of my obligations and commitment upon becoming signatory with the Union my Company (Incorporated with myself) had to pay them $93,000 dollars which was monies paid to them on behalf of me as an employee of my Company. The money collected went to various different "Funds" one of which is a Vacation Fund that is paid into by the employer at a rate of $9.00 per each hour worked by the employee. This money is then paid out to the employee on a bi annual basis in the form of a "Vacation Check". The approximate value of the monies collected going towards this Fund is $40,000. Is the Union not legally obligated to now forward this money to the employee (ME)? It was after all collected by the Union from my Company on My Behalf as an employee. Ughhh

Any help or advice is greatly appreciated.What is the name of your state (only U.S. law)?

I do not see how they can avoid paying out the vacation money. If they had a right to collect it, then they would have an obligation to pay it out. At least I would believe so. Without reading your contract, it is impossible to be sure though.

as an employee, were you obligated to apply for the funds? Is there verbiage that all funds not claimed by the year end are forfeited?

but $9/hour for a vacation fund? That is like $18k/ year. That is one heck of a vacation fund.

In answer to your questions:

As a Union Member no request is needed to get the money it is just automatic bi annually.

Not sure about money not claimed being forfeited but since the member doesn't have to request it and it is done automatically via the Vacation Check I'd think that point to be mute.

Although $9.00 is collected from the employer the employee 's "Vacation Check" is light about $2.80 per each hour due which in the Unions words "Goes towards Administrative Costs" what ever the hell that means. They collect this money for one reason and one reason only**************.Collect the money put it in a High yield account for six months and pay out to the member interest earned on the money with the the majority of the actual monies collected staying in the Unions Greedy Ass Pockets**************God what a racket!! And sooooo deeply embedded within our government. Too much power allowed to be had for a Corrupt Criminal Organization

You think the unions are in cahoots with the government? There are at least 3 states specifically trying to break the unions in their states and you think they are in cahoots with each other. Wow.

Without reading your entire contract, it is difficult to speak to things but from what you have stated, I cannot see how you would not be due the vacation money. Given the amount of money involved, I would suggest setting down with a lawyer and spending a couple hundred bucks to get an opinion of the situation. It is just not really possible to give you a dependable answer with the information known.

I believe sitting down with an attorney to be good advice and will do so.

As to my statement of them being embedded within our government....that's just the feeling I got through out the court case while dealing with this issue. We have Local City Laws, State Laws as well as Federal Laws which we all have to abide by but which it would seem LIUNA is exempt from.
