How does the system work?

I was wanting to find out if my ex who has custody of my 15 yr. old daughter tried to choke her twice and she reported it to the school counslors and the deputy sheriff and gave a police report it also was reported to cps does the county pick up those charges, will something be done about it? My daughter is scared and still in the household her father and sm are both mentally and verbally abusive. She keeps asking me if they are going to be charged for this? She told her sm when it happened and sm told her to forget about it he was upset....Thats endangerment my daughter asked sm to help and she basically let my daughter know she won't help her, and that could possibly make the sm feel she can be physically abusive too! What are the options available to me and will the charges be inforced from what info they already have. Exes wife has also threatened me with bodily harm I heard there was a new law about domestic abuse even if it is a verbal threat is this true? Thanx for any advise you can give me!

It sounds as if someone dropped the ball in the sheriff's dept and at CPS. I would make a complete pain in the a** of myself until something was done about the incident and the safety of my child. Out of curiosity..why isn't she with you?

I am going to do that I already started today! I was thinking that her being a minor would have been reason enough to get her out of the house at least.my attorney says no marks and the fact it's in the midst of a custody battle is why they didn't remove her. Then the sm cornered me at the soccer game last night screaming at me and trying to provoke me followed me to my car and shes been in trouble in the past for assaulting my exes 9 yr old sons mother and shes been turned into cps for abusing my daughter 2 xs in the past! Shes with her father because I stupidly believed him and trusted him. I had to give temporary full custody (per his attorney) for her to stay with him because we wanted her to go to a christian school and he agreed to pay for it and I lived 40 minutes away, for emergency situations etc. the school went to 8th grade after that physical custody was supposed to come back to me. He was engaged to another girl and they had a baby boy (9 now) but he ended up marrying their babysitter (her 3rd marriage) and I got a letter after that saying I had given custody to my ex and have been paying 250 a month plus extras. His new wife is the one who makes life miserable for us all, and her father used to be deputy sheriff where they live and my ex even told me the 2 xs she was turned into cps her father told her I filed the report but nothing was ever done, he has since passed away plus my exes best friend and 2 nieces work in the family court system so my attorney has filed a change of venue because she doesn't feel they would or have played fair all along! Seems like a soap opera. my exes friend tells him every time I file anything with the family courts (exes mother told me that) and my exe admitted he choked our daughter to his mother but she said she would never testify against him and his sister told me her mother told her that, my attorney is subpeonaing them both into court. But I feel it's taking way too long! I'm about to have the whole thing investigated by a higher authority for obstruction. What do think I should do?

I called the sheriff's dep. today and they said they do not have to give me any info regarding my daughters police report as I am the ncp and that they could only say the proper steps have been taken, my ex is refusing to let me speak to my daughter on the phone and I have a feeling he is going to refuse to let me take her this weekend! He and his wife have been turned into cps 2xs in the past and they have never had to answer to anything. why are they able to get away with so much, what can i do? This weekend a 13 yr old boy
knocked another 13 yr old boy off his bike and the boy whom knocked him off was ARRESTED! why then can a 47 yr old man physically choke a 15 yr old child and nothing is done? Can I request an investigation? Or is being a ncp intital me to pay support get my vsitation and nothing else? who will protect my baby? They (ex and sm) will just use the fact that they are above the law to do my daughter as they please and they live way out in the country so nobody can look out for her unless she is at school. Please help me here! what can i do?

Can I request an investigation?

You have already done so, and the appropriate authorities have apparently been looking into it. If she denies it, or if they deny it and there is no proof - what do you expect the authorities to do? Parents with custody issues make false allegations all the time - there has to be evidence for them to act on.

Ok tonight my niece (24) on my exes side and lives with my exes mother, called me tonight and said her grandmother told her that my ex came to her on the 5th (the day after the incident) and told her my ex came to her crying and admitted that he choked my daughter twice but he didn't mean to but he just got so upset (can't control his temper uses violence to control) that before he knew it he was choking her (makes him emotionally unstable and dangerous) she said (the niece) she would give a certified letter to my attorney and would testify that the grandmother told her and then we can subpeona the mom she will have to tell the truth or be in contempt! I knew my daughter was telling the truth, So many people on here just assume thet because a parent or child want to change custody somebody is making up something. And my daughter called from soccer game and said sm said she wishes that Hayley would move with me, cause then she wouldn't have to deal with her but her dad doesn't want her to go! Oh and Niece is calling cps and reporting to them what her grandmother told her so we'll see what happens now.
