What is the name of your state? Kansas If neither parent (never married) are considered custodial parent of the kid-- is custody up for grabs- can either parent get it, since they are both good parents one a minor the other legal age (just this year)? How does one go about getting the legal custody? I heard it's whom ever applies first? The child is shared between them right now while they finishing school and are working. Each lives with a parent of their own.What is the name of your state?

Mom is the sole custodian until a judge determines otherwise. In order for dad to get custody he has to petition for it in court and a court has to grant it. You heard wrong -- it has NOTHING to do with whomever applies first. THAT is a crock.

They both don't get the same opportunity to be the custodial parent they have to prove their worthiness and the courts will already be bias going into court for the mother?

Meshel...Unless you are a billy or a nanny your child is not a kid! Get used to saying child...it's easy...c h i l d ...see?!:cool:

Unmarried Dad has to establish his rights in court, this is one of the downfalls to having CHILDREN outside of marrage!! If you want to have the same legal rights as the mother, next time get married BEFORE having CHILDREN...okay?

I am not angry..well I am...but not at you..President Bush just pisses me off...but that is another story...;)
Not Judging you either...I have two children and never married...I was just relating the Legal fact of life..:) ..

Bay is NOT judgmental. She told you the LEGAL fact -- if you want to have equal rights with mom without going to court then you have children within the confines of a marriage. If you have illegitimate children then you need to go to court to acquire custody.
