How legal is a notorized document?

I live in Machiasport, ME and each year on May1 they issue clam licenses. They let out 70 licenses. I asked the clam board if my son could fill out an application and haave it notorized, and get his license. My son will be in detox on May 1 and will not be able to be physically there. The clam board said they would not accept a notorized application. Can they legally do that?

If the rules state you must be present to receive a license, it's legal. Now the question is, would you be will to spend possibly thousands of dollars challenging the rule or law in court to see if it violates any state laws or the state constitution. Of course, that could also take a few years to decide too.
