What is the name of your state? NY

A company that came to fix something in our house, turned on a gas valve and filled the house with gas. No one was injured and thankfully the house didn't blow up either. This was back in Feb 2003. We were going to see an attorney but decided against the aggravation and settled with the company for the amount we paid to refill the empty gas tanks. We faxed over signed affidavits to custard insurane adjusters - a company they hired I guess to mediate - in May 2003. Now it's almost the end of June and no check.

My question is how long do they have to send the check by law - if there is a law. They sent one in the beginning but b/c we weren't sure what we were doing attorney-wise, they cancelled the check. When we signed the paperwork we did not have it notarized b/c in our area they charge you. We did have a witness though.

My calls to this custard insurance go unreturned and I spoke to the guy at the main company yesterday about the check and he blew me off.

What can I do to get this money? Are we stuck now that we signed the affidavit? Can we go to small claims court against a corporation?

Thanks.
