What is the name of your state (only U.S. law)? RI

Wife and I will have a newborn in 2009. We both work, me being the higher wage earner.

Right now, we each claim "Married 0" and get a small refund at the end of the year.

Once the baby is born (and we are both back to work), can we BOTH claim "Married 1" or should ONLY I claim "Married1" to ensure that we do not owe at the end of the year.

Note: We are homeowners who pay a substantial amount of interest, combined income of about $120K

Change hers to Married 1. Leave yours the way it is. See what happens at the end of the tax year and adjust from there.

Follow up question....should I claim married 2 while she is on maternity leave and collecting TDI? TDI is not taxable as far as I know. (TDI is state temporary disability that you pay into)

I would recommend leaving things be. Its better to get a bigger refund than to risk owing anything.
