How to become Executor with no Will?

Situation: Elderly Mother gravely ill at this point, probably will pass away shortly. I am appointed power of attorney to take care of financial matters while she is alive. I know my power of attorney-ship ends at her death. Years ago she verbally said she wanted the oldest son (not me) to be executor, but she never made a Will. She is a widow and all her financial accounts only are in her name.

Question: Since my POA ends at her death, how is the executor appointed to care for the hospital bills, etc. afterward? Her choice is the oldest son, will he need to sign something to provide to the banks, etc. in order to pay her final expenses since no one else in on the accounts? Or can he just take the accounts and close them with evidence of a death certificate?

He will need to file probate 'intestate' and ask to be appointed executor by the probate court.
