How to cancel bally fitness contract??

January 08 we sign a "month to month" contract with Bally fitness Montclair Ca, January 09, my husband lost his job we called Bally to cancel our membership the rep that I spoke with ensured that this account would be closed as soon as the $25 was received. I taught everything was taking care of, to my big surprise they are still charging my CC I tried to called them its impossible to get them on the phone.

Reading all the horror stories about the company and since my FICO and Credit are excellent I'm wondering how can we fight abuses from companies like that.

What does the cancellation clause in the contract you signed say?

"to cancel a Month to Month membership send written notice contening the canceling member's name to: The cancellation will be effective thirty (30) days after we receive your written notice of cancellation and, if applicable, the $25.

During that 30 days period, Month to Month memberships will continue as schedule and an additional Monthly payment charged to buyer. A CANCELLATION ACKNOWLEDGEMENT will be sent, or additional documents requested, within 10 business days after we receive your written cancellation notice.

**A: so was that done? If so, dispute in writing with your CC co.

Did you send the notice?

Did they acknowledge the notice?

Was the $25 a check?

Did they cash the check?

$25 was taken from my Amex February 7 09, when I called them the rep gave me a reference number and told me I was OK when asking her "do I still have to send the letter", she said no

**A: oh brother, you listened to the wrong person and an idiot at that. Amex was not a party to the contract as the parties are you and Bally.

Wow!!! I was asking for advise Not for "speller" at least you don't have to push 1 for English nor 2 for Spanish!!! French born US citizen I am very happy about my English at least my "written" is better then 90% of US born and yet I thank for your time.

Huh??? I don't understand the reason for you rant.

Bottom line is no matter what the representative told you over the phone, you have not properly cancelled the contract. Follow the cancellation clause to the letter. Your issue should be resolved once you take those steps
