Hello, I am from Georgia and I'm very frustrated and need some advise quickly. I have been living with my boyfriend for almost 2 1/2 years. We live in a home that he leased purchased with his ex-girlfriend about 4 years ago. She lived in this home for just under a year and moved out. She has been gone for almost 3 years. We want to get married in February and she won't agree to sign the papers that will remove her from the lease purchase. I have spoke to the company that holds the mortage/lease papers and they cannot take her off the lease without her signing it. There has got to be a loophole to this. How can she still have any legal claim to this property when she has not paid a house note in over 3 years or paid any taxes on it? I have lived there and paid half of the notes and taxes for three years and to see her end up with it just blows my mind. The mortgage/lease company said there is an unethical thing they can do, and that is to forclose on the property and resell it back to us at the balance price. I don't know if I trust the company to follow through with that or not. That would involve us not paying the note for 90 days. That would be taking a big risk if they (mortgage company) were crooked themselves. We love our home and would rather not take the chance to lose it doing it that way. Is there some way we can take action on our own through a lawyer or something to get her off this lease so we can get married and get on with our lives? Can we demand payment from her for the past 3 years? Can we foreclose ourselves on her and demand payments? Please help?
