I never thought this would happen but here it is:
Father's trust is set - 2 children - each get 50%.
I have POA & serve as executor & first trustee.
I do all of the work - I manage the investments and pay his bils and deal will medical bills, etc. - I do not take any fees.
My sister, a beneficery, has now interposed herself and wants a copy of the trust & will, of all investments and has told me that she will go thru the court system to challenge me and request all copies of all money invested and spent.
Our Father has told her for years that he does not want copies of his trust & will & business papers copied - that she can meet w/the investment broker and trust attorney anytime he likes to review all information - but cannot take copies w/him.
She states that she has "rights' to all of these because she is a beneficery.
Is this true?
How can I protect my Father from this and carry out his wishes?
Do I need to be sole trustee? What would that achomplish?
And do I need to be his guardian? My Father is competent but has short term memory problems that my Sister takes advantage of.
Can my sister revoke my POA?
How do I cut to the chase and put a stop to this.?

What did she say when you told her she could review everything at the attorney's office? As a beneficiary of the trust, she has a right to an accounting of the trust only.

No. But, you just never know what she might have dad sign.

Is your father aware of what is going on between you and your sister?

She won't go. She just wants copies of everything. "A right to an accounting of the trust"...? Would a meeting w/the investment broker be fine or can she request monthly statements of everything, etc?

Yes and it upsets him. We don't know how to fight this - his memory is not good and he doesn't want conflict between children - he'd give up if it meant peace...this is so wrong if this happens.

The ONLY thing that sis has a right to is a yearly accounting of the trust--nothing else.

Talk with dad about guardianship/conservatorship for him. These can be voluntary. Your sister will still be entitled to an annual accounting of the trust though.
