:(:mad:What is the name of your state (only U.S. law)? NY

I was hurt at work on 10/12/10. sliced the palm of my hand and was rushed to the hospital, as my job is maitenece I cannot return to work for awhile. I started the workers comp claim through sedwick the people my comypanys workers claim is handle through. I notified my employer of injury immediatly and went to er immediately. I sent my claims administrator the paperwork from the hospital which states the reason for being admmited and my injury etc etc and was told to visit a doctor in 2 weeks to see about possibly removing stitches.

however sedwick asked me for another note from the doctor stating how long I'm going to be out so on 10/25 when I went to remove stitches I got a note from private doctor saying I would be out for a few more weeks...

I just got an email from from my claims advisor stating that "it boils down to lack of evidence. If you do not have medical documentation supporting your work absences starting October 12th 2010 you cannot be reimbursed for those lost wages. Since you have provided me with a note from Dr. *** taking you out of work effective October 25, 2010, your 7 day’s begins then."

Basically the paperwork from the emergency room doesn't work at all and when I went to the hospital they stated that policy prevents and er room to write doctors notes and that my paperwork with realese info should be enough.

I've been out of work from the 12 of october and won't be getting paid untill the 2 of november and only for time thereafter. Is this right?? What can I do??
