What is the name of your state (only U.S. law)? Florida

I've been married for a little more than a year. My wife resides in the Philippines with our 5 month old son. I would like to bring them to the states next year..early half of the year to live with me. I want my wife to eventually work as well. I know I have to fill out a I-130 form, but I'm not sure if I need a separate I-130 for my son who is very young. Do I need to pay the $420 fee twice one for my wife and one for my son. I've never done anything like this. I also heard that I need to fill out a G-325 form. If anyone can give me some tips or input on this I'd be grateful.

Are you a US citizen? If so, you will need to submit a separate petition for your wife and your son and pay separate filing fees for each application. You will also need to supply supporting documentation for each petition.

Please let me know if you have any additional questions or how I can be of further assistance to you in this matter. I handle these types of petitions for my clients nationwide on a daily basis.

Yes, I'm a US citizen. So, I will need two I-130's..each $420= $840. My wife has her NSO birth certificate as well as my son's birth certificate. She also got a copy of our marriage license. She lives in a rural area, so it's difficult for her to receive mail. Will this be a problem? I heard she and I guess my son will have to take a medical exam...can they take it in Cebu or do they have to travel to Manilla? Not sure if there are other requirements. What's the average time range for this process? Thank you.

The fact that they don't receive regular mail should not really be an issue as you will be getting most of the mail initially and then for the consular stage, it is sent via email from the NVC. They will need to get their medical exam done by an authorized physician and when the time comes, you/they will receive a list of those physicians some of whom may be in Cebu and others in Manilla and other cities. That will not happen until the petition is approved by the USCIS and forwarded to the Consulate for interview scheduling.

It should take approximately 9-12 months from start to finish, on average.

Please let me know if you have any additional questions or how I can be of further assistance to you in this matter.

Do I need to fill out a separate G-325 form for my son? The biographic form. Do I also need to provide passport size pictures of my son? He's only 6 months old. I advised my wife to get a passport, but I don't know if it will be a problem for my son to get a passport since he's so young. I appreciate your help. Thanks a lot and I will be sure to ask questions when they come.

Actually, if you were a US citizen and married to the mother of your child at the time your son was born, he may qualify for automatic US citizenship. His birth needs to be registered with the US Embassy in Manilla and he may be able to get his US passport so you do not need to petition for him. For that, you may need to be present in the Philippines as both parents need to attend the interview.

That sounds a bit complicated. We got married before the birth of my son. I'm a US citizen. I cannot travel so easily. My wife and son are in Cebu. I will make a trip there early next year and hoping to bring the two with me. I cannot make multiple trips. Is a passport required for a 6 month old -1 year old. If I cannot make it for an interview can he obtain a Philippines passport and later also obtain a US passport (dual) in the States.
