Hello,
Currently I am working, as a Research associate in University of XX and my current status is H-1B valid till 03-01-2016 to 02-28-2019. I have an approved I-140 in EB-1A (2nd attempt) and preparing for I-485.
I was working as a post doc at University of YY on J-1 visa from 05-01-2009 to 04-30-2014 and on 04-01-2014 (just before end of J-1 status) I filed for green card in EB-1A. My EAD was approved in 06-21-2014 and then I was continuing my research work till 12-18-2014 the day my first EB-1A petition was denied. My supervisor then filed for H-1B and change of status, and it was approved on 02-10-2015. I was out of status presence from 12-21-2014 to 02-09-2015, 55 days out of (maximum 180 day allowed).
The change of status from J-1 to H-1B was approved while I was out of status. USCIS again approved the H-1B transfer and extension from University of YY to University of XX. With valid H-1B from 03-01-2016 to 02-28-2019 but no visa stamp and approved I-140 in EB-1A, is it safe for me to file for I-485?

While being a bit saucy because of adult beverages, I suggest that the many numbers in your post would require an attorney.

We tend to not practice law here. On purpose.

Perhaps if you give the issue in words, some might opine.

(Don't get me wrong, you need to keep and express to your eventual attorney the numbers. Here? Not so much.)

I declare this quincy. (aka Seek an attorney.) I may be wrong, but such advice rarely is.

Good grief! You earn many times the average wage of Americans. You certainly can afford a good, experienced (i.e. expensive) attorney for something this important to your future. Quit being so cheap!
