What is the name of your state? MI

Hello,

I was asking some questons to USCIS about living in the United States permently and they said my Step-Father can sponser me, so they gave me the forms and everything, they told me ill need to get an I-94 from the U.S. Border (when coming from Canada), now the reason why I have to get a I-94 (as they say) is because ill need to put down on the form my I-94 number and information about it and also ill be in the States while filing for the Green Card.

My mom thinks that Immirgation is doing a Trap for me so when I go across the border and ask for the I-94 and tell them that I am staying in the states while my Green Card is going through, that they will reject me at the border and ban me for a few years. So what is the proper way to go across and do I really need a I-94 when entering the U.S. and applying for my Green card? I really don't want to get in trouble and well should I come across the border (entering the U.S.) with my Step FAther (U.S. Citzen/Sponsering) or my Grandfather (who is a Canadian Citizen)?

Thank you.

Your mom sounds smart!

It's illegal to come to the US as a visitor (Canadian) with the intent to immigrate (get your Green Card without leaving the US for a visa).

The proper way is for your step father to start your petition, and for you to go for an Immigrant Visa apointment in Montral when you're called.. 9-12 months from when your dad starts.

I don't understand, Montreal is way...FAR, I mean I thought you are allowed to stay in the United States while filing for a Green Card, I called USCIS Hotline and I told them that I don't have a I-94 and I don't have a Non-Immirgrant Visa and the Officer said "Put down N/A for both fields on the forms" because I guess the Border doesn't really give out I-94's to Canadians.

My plan was to go over to the U.S. and have my Step Father sponser me for my Green Card (Perement Residency), I called USCIS and they said it would take 5-6 months to go through.

please respond ASAP.

You need a specific visa to do what you are planning. It is illegal to enter the US as a tourist with intention of remaining and adjusting status!!!!!!
Did you bother to tell USCIS that you are NOT currently in the US? Their advice seem fitting for someone who did enter legally, and all of a sudden without prior intent this sponsorship opportunity arised. It does however NOT fit for someone who is NOT in the US, and planning to jump the line of people waiting for proper visas in order to move here. USCIS is not going to advice you to beak their own regulations, although the phone operators there don't know diddly about immigration!
Of course you don't have an I-94 if you are outside of the US.
