I would like to introduce me as Sitaram Reddy
CEO of globalEservices Inc., a non-profit organization.

I have my friend Ravinder Reddy with the following specific immigration
issue. Please suggest me your opinion. Thanks a lot.


Ravi came to US on July 1997. At the PORT OF ENTRY, Immigration dept gave
the I-94 - Expiration date is MARCH 2000.

IN 1998 ,His Employer got one more H1B approvaL. Along With he got one
more I-94(NEW), Expiration date is 01-JAN-2001.

In 1999 DEC , he went to India. At that time, he had done a mistake that he
did not submit the new I-94. And then he returned the same way without
showing the new H1-B approval at the POE.

His old I-94 got expired on March 2000.Now he is using the new one.That
expires on JAN 2001.

Now he approached his employer to get the H1B extension. His company lawyer
is telling that he is in out of status from MARCH 2000.

Please suggest us on this. What he could do to avoid deportation.

If the company has an Immigration Attorney then his best route is to ask the attorney. The company will be interested in this too as if he is working out of status then they could be in trouble to.

I do not think he would be deported, but an attorney is needed to sort it out.
