My boyfriend and I have been charged with 2 class b crimes, one was allegedly breaking into a home and the other was allegedly stealing 80 oxycontin out of that home
The reason our names were given to the police as supects was because it was my ex mother and father-in-laws house and they are aware I am a recovered opiate addict. I have been clean for months and months and am still under a physicians care, so I can show consistently clean urine tests...anyway, Their home was broken into and I happened to be in the same city that they live in that weekend so the cops came over and questioned me. All I said was that I had been Christmas shopping. I had also been in town the weekend prior and stopped by their home to see if my children were back from church yet (they go with their grandparents every weekend). When I arrived at the home, my ex father-in-law was there, he said he had stayed home sick from church, but the children should be arriving at any moment..I waited for about 5 minutes and then had to leave..he hugged me good-bye and out the door I went. When they (parents-in-law) spoke to the police, my father inlaw made it sound like I had been over there casing the joint...he changed the whole story..the guy was so heavily medicated when I saw hime that he was having a hard time keeping his eyes open and was slurring his speech. I'm sure he remembered my visit cleary.
Anyway...a neighbor claimed he saw whoever did it, so the police showed them a line up that day with my picture included and the man chose a girl that outweighed my by about 150lbs. and said that it looked like her but wasn't her. Then a day later he was shown another line up...this time my picture was when I had just had my son, so I was about 50-60lbs heavier than I am now, he points at mine (other heavy girl is out of this one) and says "It looks like her but it isn't". A week later, the detective shows him yet another line up with my booking photo, and the detective claims he pointed at it with 100% surety. Riiiight. My guess is he conferred with my mother and father in law and went through other photos....they convinced him it WAS me so when the guy sees my pic a WEEK later, he's suddenly positive. I find that a little funny. Other than this guy, they have NO evidence. I even have a person who will testify that I could not have been in town at the time of the incident.
Finally...I'm wondering if it's a good sign that the DA offered 2yrs probation and 10 days in jail if we accept the two felonies, then turns around a month later after we denied it and offers the same deal but we only have to accept one felony...I don't believe they have a case and are just grasping at straws...what does anyone else think?What is the name of your state?What is the name of your state?
