Question regarding trespass notices

What is the name of your state? California

I served an ex tenant that caused $7,000 in damages a DO NOT TRESPASS NOTICE outlining that he nor his family may step foot on my building property.

I have heard dozens of times that he comes around and drops his destructive son of at one of the units at least twice a week, the other day I went around the units after a call stating he was back and the son was kicking a ball around in the parking lot and tenant car alarms kept going off.

When I got there I saw the ex-tenant picking his son up jump in his car and drive off.

Is there any official court order document that I can have served on this guy to stay away from premises, he does not seem to get it?


Here is the violation code I served on my own letter head.

9.20.070 Trespasses upon private property prohibited

B. No person, without permission, expressed or implied, from the owner, owner's agent or lessee, shall enter upon such private property or business premises after having been notified by the owner, owner's agent or lessee to keep off or keep away there from.

have you ever called the police on this guy?

where i live (hillsborough county, florida) if you call the police and they tell the person to leave, they write up a note that looks like a traffic ticket stating the police officer told the person to leave and give you a copy. as soon as you have two of those tickets, you can take those tickets to court and have a restraining order issued. next time the person shows up, they will be arrested instead of being given another ticket.

I know I can call police if the guy is there I always hear about it after he comes and goes, the closest I have been to catching him there was when another tenant told me the ex-tenants son was kicking the ball around against the cars I got there just as he was leaving.

I know the notice I gave him officially restricts him from entering property regardless of why he is there even if his own mother lived there problem is calling the police only works if he is there when they arrive.

The kids a destructive little shi@ stamps on plants pours drink into mailboxes etc etc that is why I need to get something a little more concrete to serve this family with.

I read through a Restraining order it does not seem to apply and is temporary if approved.

**A: you need to file a police report and have the cops talk to him. So he knows the next time he steps foot on your property, they will arrest him.
There is more to this story and reasons why he still comes around..

P.S He comes around because he knows one of the guys in another unit and he leaves his child there a couple of times a week at least, to hang out I would imagine with the boy that lives there.

One of the reasons I had to get him out in the first place was he stopped paying rent because he wanted to buy a house, and the constant daily destruction of property inside and out by the parents and the son, writing on perimeter walls throwing open paint cans against the paths/walls, kicking flower heads off, leaving faucets running night and day, breaking car windows, kicking holes in walls and doors inside etc etc

And you would not believe how I lost my case when I sued him after he left which I bet now makes him feel he can do what ever he wants.

Sounds like a real Tool, and I am sorry to hear you lost your case. Just think what his kid is doing to his own property and sit back, eat some cheese and chuckle, my lad.

The little shi# still causes damage thats why I need to do something.. After losing a tight knit case because of a crazy mistake by the court its insult to injury to continue having problems with someone that is now an ex-tenant.
