What is the name of your state?What is the name of your state?My question concerns my dad (80) and my mother (76). My dad was in a nursing home put there by a Dr. @ hosp. due to hurt hip. He stayed there a little over 30 days. I had medical power of attorney, I requested that he remain in facility. The facility was not ready to release him due to his current state of health. However, my mother came and took him out of the facility even though the Dr. had in the chart that my dad was not able to make his med. decisions for himself so they used my power of attorney. I contacted Adult prot. Services of all this. However when the State worker went to my parents house, they let my dad remain in the home and even went so far as to tell my dad that he could revoke the medical POA by writing void on it. My mother is not able to take care of him properly(health problems, bad back etc.) that is why I contacted APS in the 1st place. He has been home since Sat. 8/14/04 and he fell @ home the very day he got home. My mother does not have medicine or know what do give him since the nursing facility would not give her anything since he was released against medical advice. Today my daughter (the grand daughter) went by their house and she told me that my dad was already coughing due to his congestive heart failure.( No medicine or incorrect medicine is being given to him) What can I do??? Also, I was a signer on my parents checking account. My mother owed money to me so I transfereed $900 from her account to mine. My dad was aware of this. However now that he and my mother are both mad at me, she now says she is going to file a lawsuit against me for the money. Do I have anything to worry about on this? confused: What is the name of your state?Texas

Did your father revoke the medical POA?

Do you have a medical POA for your mother?

Do both your parents have the same primary care physician?

Is the investigator filing incompetency papers on either or both of your parents?

Do you have an attorney that deals with Elder Law, particularly with guardianships/conservators?

If not, make some calls to attorneys tomorrow. Also call your father's physician to acquire prescriptions and update the physician on your father's condition and your mother's condition (inability to care for your dad). Should your father's situation warrant, call 911.

P.S. With the assumption that your parents have been married for a long, long time, keep in mind that keeping them together is very important.

Yes, you could be charged with theft. You are only authorized to use money withdrawn to help people with their medical/living expenses. If your mother owed you the money, you were supposed to accept repayment when SHE takes the money out or however she decides to repay you, NOT taking it out yourself.
