My situation is a bit long, but I will try to make it short and with as much detail as possible.
My ex husband and I have two children. We divorced in 2010, in Kentucky, which is where I used to live. The children and I moved to Missouri and have resided here since. I remarried four years ago. My ex husband would see the kids twice a year, if that. His child support was sporadic at best. Two years ago, he stopped paying all child support. We went to court in Kentucky and the judge said he could have visitation on the 3rd weekend of each month, but his current girlfriend was not allowed around the children because of her extensive drug and assault history. He saw the kids the weekend following that court hearing and did not follow the courts orders and had the children around her anyway. Since that time, he has not seen them, even one time. He married this woman, and refused to see the children because he would not make her leave.
Fast forward two years.... My husband and I filed a petition in May of this year to terminate my ex husbands parental rights and for my husband to adopt. We could not find my ex, so a public notice has been published in the newspaper. Yesterday, I get a call from my old attorney in Kentucky, saying that my ex had his attorney call him and said that he and his wife are no longer together and are getting divorced and he wants to start seeing the kids again. We are two months in to this petition to terminate his rights, and I don't know what to do. We are afraid that without him being physically served, that if his lawyer in Kentucky finds out, he may file a petition to make me come to court in Kentucky and we don't want that. Any suggestions or advice is greatly appreciated.
