I Need Help With Custody Of My Son

What is the name of your state?I am active duty military. Back in March of 1999 my wife and I were given a son from the state of Florida. It was a blessing since my wife could not have children. It was from a family member who was abusive and mental not capable of taking care of her self. We pleased to her that child custody in Florida signed him over to us to take care of him and his mother as well. I decided to addopt him since the mother already signed him over to us and the state of Florida as well. It seemed to go well till I got the run around about the natural father. Who she did not know and kept guessing names. After 1 1/2 years I gave up. The father was never going to be found but, the court judge insisted he would. He has lived with us for 6 years and is now living in Florida with my mother and sister with her 3 kids about the same age. Right now he is doing very good and is very happy he tells me. he is on the schools honor roll every quarter, in excellerating classes, and took first place in his schools spelling-bee, attends the YMCA every day after school. I still support him fully. Reason is my wife became ill to the point she was hospitalized. Now my wife has passed away. My sister in-law out of know where steps in to try and take him from my family. She wants to give him back to the natural mother. nether one has talked to, asked about, seen him, or even cared about him till now. I ask for help because I do not know what to do right now! how is this possible? why is she doing this? I just don't understand! Help me please with some answers!!!!!

Have mom's rights been terminated? Are there court papers awarding at least guardianship of the child to you, your wife, your mother, your sister, anyone?

VeronicaGia, she does have visitation rights even though she has signed him over to us. She does not want any think to do with him any more so she refuses to visit. I am in contact with her mother and her mother told me last night that she is still having a problem taking care of her self. Her mother wishes him to stay with my family who she stays in contact with as well. there is papers from the court given us guardianship of our son "YES!".

Is the child living with your mother and sister because you are deployed? What is your sister-in-law's relationship to the child? Do you officially have legal guardianship (signed off on by a judge)..or do you have CPS "placement"? If you are not deployed then why isn't the child living with you?

LdiJ, the sister-in-law has no relationship with my son. That is why I am very surprised after 6 years that she would even think of taking him away. He is not related to her at all. She is a type of person who acts before thinking and does not care who she hurts I know this. The only thing I have is a court document stating that the state of Florida (social workers, child placement, and IRS) have given us the custody and to be in the care of us. The natural mother has signed him over to us and also does not want him back. She knows where he is and the care that is being given to him. Also, we stay in touch with his natural grandmother who also is supporting us as well and is happy where he is. The only one that is saying any thing is the sister-in-law. Why? I do not know. I am in the Navy which means I can be deployed at any time. I am an inspector who certifies ships to be safe to get underway on deployments. Plus, they have just introduced surge deployments which are unexpected 3 month underway at any given time. I feal it is best for my son to be in one place where he is happy instead of being moved month after month.

If she is not related to the child, then she has absolutely no standing to bring forth anything into court. Tell her to mind her own business.
