What is the name of your state? NY, My 16 yr old daughter is dating my 1/2 biological brother. No where on paper, anywhere, can we be linked as brother and sister. My father was never on my birth cert. and I was legally adopted by another man at the age of 2 so all my hospital and birth records are sealed. I did not grow up with my brother and my daughter never knew my brother so neither of them "feel Related"!!!! I understand this but I told them that they ARE related and I know they are as well as other people in my family. I know some of the law in NY that says this is incest. 1/2 or whole blood, mother/son, father/daughter, aunt/nephew, uncle/niece are all considered felony crimes. I've tried to tell them this and they are trying to tell me that they are not 1/2 or whole blood and don't intend on having children, right!! I don't condone this and I am very angry at both of them. I am about 20 yrs older than my brother as I was the first born to very young parents so I think I have a better grip on this than the two of them. I need to know if there is a law on this that better explains "lesser" blood, I know that 1st cousins can be together and get married in NY and that isn't helping me in my argument any. PLEASE HELP ME:confused:

Your daughter is a minor. You have total control over what she does. If you aren't stopping this incest, then YOU are the one at fault.

Get a restraining order against your brother, and if that doesn't work then move as far away as possible to keep the two of them apart.

Well let's see.....

one hand: come to an internet forum and play 'what-if'....

other hand: call the police.....

one hand: waste time getting advice from strangers who don't know the entire situation...

other hand: Contact the district attorney......

It doesn't matter if they're not blood relatives, they are part of the same immediate family, which makes their humping down right DISGUSTING!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!! How can you sit by and let your brother **** your 16 year old daughter????????????????????

When it involves incest, underage persons engaged in sleazy sexual activities, and a lot of frantic "writing," I usually assume it's Old Smelly. ;)

*edit* Now that I've noticed OP has more than 10 posts, I may (may!) be wrong about Smelly. Maybe.

Sigh.

I, for one, find all the "attempts to 'out' Kelly" to be very tiresome. WE do NOT need to have constant posts such as "Shut up Kelly" or "Go away Kelly" or whatever. If YOU feel it's a Kelly post, then ignore it.

There are plentry of strange situations that exist out there. They don't have to have Kelly's name interjected all the time

The law is somewhat vauge re this set of facts, especially since there is no legal record of the relationship and no DNA proof of the proported relationship. OP cannot be certain the man claimed to be her father is in fact her biological father.
http://www.health.state.ny.us/vital_records/married.htm
Familial Restrictions

A marriage may not take place in New York State between an ancestor and descendant, a brother and sister (full or half blood), an uncle and niece or an aunt and nephew, regardless of whether or not these persons are legitimate or illegitimate offspring.
According to this OP cannot mary her half brother, however it is less clear re her proported 1/2 brother marrying her daughter since the 1/2 blood restriction is between brother's and sisters and apparently, there is no restriction between step siblings since there is no biological relationship.

Thanks

Well I guess that when you ask a question on here your going to get every answer but the one you want. I know this is yuck and all that other crap, I want the law not personal opinions. Thank you all anyway.
