My 21 year old sister has a 1 month old she doesn't want. The baby's father is not in his life. My husband and I want to adopt him, what do we need to do in order to make this happen?

Have you thought about WHY the presumptive father is not in the child's life? Does she even know who he is? Does he know about the child? Has he stated that he wants nothing to do with the child? The LAST thing you want to happen is to start the adoption process, and then find out that the dad who never knew about his child suddenly appears and asserts his parental rights.

While the mom will probably voluntarily sign to terminate her parental rights to the child, you need to make a concerned effort to identify, find, and have the father sign off on the deal as well. Unless and until the presumptive father terminates his own parental rights, you CANNOT legally adopt the child.

I would suggest hiring a good adoption attorney to assist you with this.

Does this FATHER even know he has a child? ??

Hire a QUALIFIED ADOPTION ATTORNEY to assist you. Father and mother both should have their own attorneys to protect their rights.

Mother should also seek counseling to assure all that this is not just post partum making a life choice for her and the child.

It's kind of strange for a woman to decide she doesn't want a baby at 1 month, is this young single mother suffering from some sort of postnatal depression??? As others have said you will obviously need to see an attorney but I would caution about taking advantage of a situation where the mother may need social support/help rather than giving her child up for adoption.
