I have received 2 seasonal passes from my mother-in-law for a local water park as my birthday gift. On last Friday, we decided to have some fun so we went to the park ( we have been there several times since we got the passes).
We were in the big wave pool. It was very crowded. My husband was teaching me how to swim, and we were having fun such as holding each other up while the other person is floating in the water etc. We did NOT do anything that was SEXUAL nor did we EXPOSE OUR GENITALS. Later on the security guard who works for the water park (He is NOT a police officer) pulled us out of the pool. He sat us down at the office, told us that someone has complained to him about us, then he informed us our passes has been suspended without any negotiation. We were shocked and my husband asked him what was going on. He started to threaten us with Misdemeanor and Lewd Acts. He did not care to explain what was going on nor did he care to hear our side of the story. My husband requested him to double check if his information was correct, so he left for a few minutes and came back claim that he was not gonna suspend our passes but he needed to record our names and take our pictures. He did not explain why he needed to do so. So my husband gave him his name and had his picture taken, but I felt mistreated so I said, "I do NOT think I have done anything wrong and I do NOT want my picture taken. If you want to suspend my pass then go ahead and do it." The security guy was a really big guy, and he had a gun equipped. My husband felt intimidated, so he took my hat off and pulled my hair a bit to force my head up(My husband was not violent). The security guy took a picture of me, frowned, then told my husband "Hold her head up." so he took my picture again. Then he let us go. At this point I was very very upset and went to their front office and started yelling at them. Some guy who worked there started apologize and went off to check on what happened. Later on the security guard and some staff came in and apologized to me and claimed "it was just a misunderstanding." I felt wronged, humiliated, and treated like a criminal so I stormed out.
I have been thinking taking some legal actions against them. But I do not know what category would this incident fall in (violation of privacy/civil rights or misconduct of business?). Is this case worth me to get an attorney and take this to court? Is there any places that I can file a complaint to? Thanks.
