I worked for 6 weeks at a local Tax preparation business in January and February. I was hired by the CEO of the company and she agreed to pay me $12/hr bi-weekly. Since I worked alone at a satellite location I kept track of my own hours and emailed them to my boss.
I started working on 1/5/11 and got my first check, for week 1, on 1/28. I didn't have any problem with that amount. However 2 weeks later I got my check for weeks 2 and 3 and it was less that what I should have received. I tried talking to her and the payroll manager about it and they basically escaped the office through a side door.
I talked to a secretary the next week and she told me that they were paying me $10/hr plus they were adjusting my hours to reflect an hour lunch break, even though I was taking, and reporting, half-hour lunches.
Since then I have been planning on suing her in small claims for the amount she owes. But, I'm still owed for 3 weeks of work that she hasn't paid me at all and the office is now closed. My former boss is not returning my calls or responding to my emails so I assume she has no intention of paying me for those last 3 weeks. Plus I heard from some of my clients that she pocketed most of their tax refunds.
Is it possible to bring criminal charges against her? Also, which agencies should I report her to?What is the name of your state (only U.S. law)?
