What are the chances of proving Intentional Infliction of Emotional Distress on my daughter? How can It be done? Should I take her to counseling?

Here are the reasons;

They moved in with a family member (3 people) from one county to another (totaling 9 people all together).

she sleeps in the living room on the floor and sometimes on the hide-a-bed. (she doesn't have a room)

They force her to tell them information about me, to the point of crying hysterically.

Father has told daughter that he's going to have me shot

She is left in her 11 y.o. sister's care, during the days they are not in school. (Law states to babysit they have to be watched by someone over 13 years)

She is emotional about everything; losing money to messing up on her homework to spilling milk, you name it.

She has gained significant weight this year she's 8 and weighs 72 lbs, last year she weighed 50 lbs.

She is afraid to tell the truth because she will get spanked by step-parent

She is made to get up at 5:00 am to get ready for school (doesn't start until 7:50am)They don't return until 7:00PM each night.

Her teachers have noticed how emotional she is- if she's reprimanded in school or gets frustrated, she cries in class

Father is not in household for 3-4 full days a week.

She isn't completeing homework, day dreams, and feels frustrated when she's under pressure.

Had to be physically removed by teacher once.

I am going to file, after we have a few consultations with attorney's. I set up a meeting for this upcoming weekend.

And truth be known, I am a little scared of the possibility of losing, I 'm afraid that the Judge won't grant a change of venue, or won't listen to my daughter, or they may not give me custody back of her.... My worst fear is having to look her in the face and expalin we lost the case, and telling her they said she can't come home.

I know I have at least some justifiable evidence against them, and there is the possibility of winning. I am going to be very picky when it comes to an attorney representing us in court. We can't afford to lose, my daughter is the one who will suffer in the end, and I don't know if I can handle if we lose.

I am doing most all of this alone, I don't have anyone to standby me for support or to lean on. My X has alot of manipulative influence on people, I'm scared to face that all over again. BUT I am willing to do anything for my daughter's well-being and happiness. If she said don't take her back to her father's ever again and let's runaway today, we would! Of course running away is easier (at the moment) than facing that scum in the court room.
