Kido posted the other day about my situation regarding the custody hearing last month. The attorney i retained has been disbarred since January 2004.

I received the court order Saturday. It was signed by the judge on April 7, 2004.

Is this order legal? I am in the process of finding another attorney to represent me in this matter...so far not much luck. My situation is a difficult one and not many attorneys i speak with want to take this case on. Any advice you can give will be greatly appreciated. Thanks!

I understand that i can appeal this order within a certain time frame. What i don't understand is whether or not I should abide by this new order until I get this back in court OR abide by the previous court order.

Both orders allow him to receive supervised visitation, but at different locations and with different supervisers.

My response:

First, you don't appeal anything. You file a Motion to Void Court Order with the issuing court - - stating your basis and reasons; e.g., lack of compentency of counsel, and the reasons therefore.

Second, until the court hears your motion, the current (new) court orders are in effect, and you SHALL obey those new orders.

So, you've got some work to do.
