My son (16yrs) has an IEP dated 5/11/06 which is not be implemented completely. School only started to comply after steps were taken to get legal advice. Main problem-a school rep on 8/26/06 hand delivered an IEP dated 4/21/05 reviewed on 5/11/06 as my sons current IEP. NO mention of 5/11/06 IEP in which she was present at the meeting in which it was written though she claims I was given a copy of the IEP she delivered to me on 8/26/06 in the 5/11/06 meeting. Met with school reps including principal and person who hand delivered old IEP on 9/6/06. The only IEP brought to meeting was brought my me and was the copy the school rep hand delivered and claiming it was current. I left the meeting thinking I'd let my son down and couldn't enforce what we agreed to on May 11, 06 because I didn't do my job as my son's advocate and get a new IEP written. I get home evening of 9/6/06 and find in my possession copy of 5/11/06 IEP which I was given a copy of on 5/11/06.
I believe by submitting an old IEP as current when the school has a copy of the current IEP they attempted to commit fraud by denying a new IEP was written which would address new diagnosis for my son and give him a means to get the best possible education he deserves by providing a learning environment tailored to his need. Since threatening legal advice some progress made but still want to know what recourse I have. I have documentation in form of IEPs and emails trying to get help to implement all of the IEPWhat is the name of your state?
