What is the name of your state?NEW JERSEY, Hello, what if I cannot get legal aid help, and cannot pay for a lawyer, has anyone filed chapter 7 with an online place thats helps you file and charges alot less in fees then a lawyer or even someone who has filed chapter 7 on their own? I have recieved a court date for the summons I recieved, thats a court date of oct.6,05---also does anyone know what it means on a credit report when it says (charged off)? Im sorry if that sounds like a dumb question, I got my credit report and there are several that say (charged off), thank-you, jan

The law does permit you to file for BK without an attorney. You'll be required to pay the filing fee, currently at 209.00. You may do it on your own or can enlist the help of a paralegal or online preparer. Choose wisely the course of action you take. A lot will depend on how "simple" your case is. BK attorneys offer free consultations.. get a few.

Charge-offs are simply an accounting tool that creditors use to rectify their profit/loss columns. It does not mean that you don't owe the money anymore or that they have given up their rights to sue you (providing the debt is still within the statute of limitations).

Great! Then you shouldn't have any problems. If going pro se, give yourself a little time and pay close attention to your clerk of courts instruction. Oct 17, 2005 is when the new laws go into effect.. so, try to file before then.

There's a BK book on the market that everyone raves about by Nolo Press. (I didn't find out about it 'til after I filed ) You might want to give that a read.

With a lawsuit hanging over your head, your BK case is NOT simple. If you don't do things right, then you'll be stuck with the judgment after bankruptcy anyway! There have been several people here who thought that a judgment would just evaporate after bankruptcy only to find themselves being pursued by the judgment creditor !!

You must be aware that these on-line preparers are being deemed as promoting bankruptcy fraud by some BK courts - that is something you do NOT want. We The People was taken to court and slapped for the illegal practice of law so you need to be extremely careful. You'd be better off buying the NOLO book and doing it yourself than risking your case with an on-line prep place. Better yet... get an attorney. NJ has a pro-bono network if you don't have the money.

Denied bankrutpcy ?? Not under the CURRENT law. You either end up with a CH 7 or you get stuck with a Ch 13, but your case sounds like a Ch 7. Once the new law goes into effect in Oct, it will be extremely difficult to file CH 7.
