If i get remairied can the court go after my new wife's income for more child support? Will she be liable to pay any of my back owed support or maintance.
Thanks for the help.
In a nutshell. NO.
However, if you are unemployed or underemployed they may take your wife's income into consideration, not for the calculation of child support but to determine how much income to "impute" to you.
In addition, if you owe serious arrearages they might take you wife's income into consideration in deciding how much of your income to take for the arrearages.
In other words, if your wife is easily able to support your combined household, then they might make you pay a higher percentage of your income towards your combined child support and arrearages than they would normally require.
This isn't a very common scenario though and generally wouldn't come up unless the court thought you were playing games.
