What is the name of your state? Michigan

If I pay a prepayment penalty so I don't lose the refi, can I then go back after it if I find out for sure they weren't entitled to the amount?

If you signed the pre-payment penalty note rider when you closed on your loan then you will have that penalty until it expires. Why do you think you don't have to pay it?
