OKay.. my husband was unemployed 2 years ago and got a partime job first then a full time... so he worked 2 jobs. The employer at the full time job got wind that my husband had the part time job ( the fields are in no way related..so there is no fear of competition) and started to make his life hell until my husband promised he would leave the part time job.

Is this legal? can an employer really force their employees to quit something that is outside of the workplace?

Would this be considered work place harassment or discrimination?

They cannot force your husband to quit the second job. However, they can legally fire him if he doesn't.

Harassment and discrimination are only illegal if they're based on things like race, religion, disability, age (over 40 only) or gender. If your husband's employer is ordering your husband to quit his other job solely because of your husband's race, religion, disability, age or gender, then your husband may have a case for workplace discrimination.

That's what I was afraid of.
My husband is African American and over the age of 40, but proving discrimination on something like this is going to be very difficult.

His race isn't the issue...His extra employment is. As CC said...DO NOT GO THERE.

Do not think of minimizing the LEGITIMATE discrimination that many people suffer/d to fight THIS battle. That would be incredibly wrong.

The fact that he "is African-American" does not, in and of itself, give rise to illegal discrimination. Everybody has a race.
