I have a couple of questions.
I live in nys. I worked part time at a company and was never given an employee manual to know how the office works.
1. I am what I would consider to be an at will employee, I think. I was told that I could have my position as long as I wanted and they hoped to have a long and happy relationship with me. Did this imply more than at will???
2. I have never signed anything with my employers except the right for w2. also, I was a part-time employee. The only time I was ever spoken to (disciplined) was to be told that employee should not be talking to other employees how much they make and other employees make, even though all employees did. And was never given a warning. I thought that doing a complete investigation before termination, including asking the employees for their side of the story was what is supposed to be practiced, is that true? . I thought that to advise marginal employees of their performance problems. The news of a termination came as a surprise. Was the way she carried out the termination and Also, after asking me to leave, she watched and hovered over me while collecting my belongings and escorted me out, defamation?????? Was it illegal for what she did and how?
3. They are also withholding a reimbursement check for parking and having an internet connections at home installed, about 80$
4. During my work I was asked to train another person on how to do part of my job. I sat down in front of a computer with her and told her the steps as we went along. I used a binder that contained information, prepared by myself, which contained program procedures. as I was sitting, I took notes for my benefit, for comparison to these already printer documentation, to see if changes would need to be made, or updated. After being terminated, I was asked to produce those papers, which is all just non-sense notes to myself, like put in disk, click next, click ok; procedural information, and nothing pertaining directly to the company, of which they already have, that i had previously provided to them. my pay is being with held from me for failure to produce these papers. I do not feel that they have a right to these! do they? the manager made a point of saying it was done on work time and they belong to them, even though I feel I provided the training as asked, I was not asked to write them anything. Also, the only reason why they want them is because they are unaware of the fact that they already do have these notes, in a binder, but are “too lazy” to look for.
1. When I had professionally asked for a raise via typing my qualifications and assets to the company along with request for raise, I was told by the manager that she was so mad at me that she was going to fire me. Was this a threat and was it illegally?
2. The owner, whom called me into his office for my assistance told me that he would punch me for standing behind him. Illegal?
3. My performance review was 3 months over due, once I finally received it; I was not given pay retroactive, illegal? All other employees there do receive theirs retroactive.
4. She told me she was cutting my hours, so my paycheck would stay the same, which didn't make any sense. I feel that this created a hostile environment in an effort to make me quit or intending to make the job intolerable. She had no ground to let me go, so I feel this was a way for her to try to get me out. I had received nothing but praises from all others there.
5. I was finally let go from a conversation I had with the person I had train. She was an employee there as well whom had assisted me from time to time when too busy. As I was part time, and I felt the position warranted full time, because there was always something going on and if I was not I the office, they would call me at home, I had asked the manager for full time, she SD she would consider it and get back to me. After speaking to her, I went to that person and the following conversation took place:
me: I asked the manager for full time, so everything can get done, and I can stop interrupting your work as secretary to help me. what do you think me chances are?
her: probably slim to none.
me: yeah, the manager did not answer me, she’s probably afraid I will not finish the year 2000 project if she tells me no.
her: you shouldn't have SD that to her.
me: I didn't (at this point I was confused as to why she SD I should not have SD that to the manager, when I had SD the manager probably thinks.)
The next time I was at work, I was called into the manager’s office and let go for this conversation, with no warning or asking if it was true, or anything, illegal?
1. when asked why I was let go, three weeks later, she SD it was because she was told by an employee that I would not do my work if they did not offer me full time employment. I then asked, "have you ever had a problem with my work?" I was told that there was never any problem with my work. With this I asked then why would you assume that there would be now? And stated that whether or not they offered me ft or not, I was still going to stay on part time, but work ft somewhere else. She also SD that she was afraid that I would do something, after telling me she never had a problem with me.
Also, I feel the manager was having me train the secretary to do my job and give me the boot because all of the big projects that I had to do were done. And she had sent the secretary out many times for training and not me. I had questioned her on her intention and she SD she would never do that, but it seems as that is what is taking place now. Is it illegal that what I feel her intentions were was to use me to do all of the big work that required some special skill and I feel she used me to solely to "pick my brain." As I would not have stayed, or worked for the rate I had, with these false intentions. Since I left, they have a hired a temp to do work at a basic skill level, nothing like what I was doing. This helps to support the theory that they used me, and they threw me away and got someone in for half pay.
Also, I was told by this same source about 2 months prior that the manager wanted to fire me. Her reason being that someone was discussing salary, but everyone there does and did. I was in the position that my job had a full plate, and was kept very busy while there. I’m not sure how she came to this conclusion. I had never said anything. The incident before where I was spoken to about pay, was me speaking to another employee about how much I was receiving because I knew I was being underpaid, and she was discussing with me the fact that the previous person there had made 2x as much as me, to do less. Also, the previous manager and system admin persons had left at the same time. So I think when they filed the position of office manager with the current one, she marketed herself as being able to do both jobs, but was grossly incompetent. The person had also stated that the secretaries at the company and even the receptionist were making a lot more than myself. So I was not even really discussing salary, the other person was. And how would I have access to what people make, and why would it matter, I was the only IT person there. So my rate should have been compare with someone in the IT filed with my qualifications and work load, not what anyone else there was making. But the secretary supposedly told he was of asset to the company and not to. Did she have right to talk about me to other employees? The manager had also made negative commetns on numerous occasion about me to 2 other employees. Defamation?
And, I confronted her about being told this. She says that the comment was never made and if she needed to talk to me she would. So in her attempt to not look bad, she was in essence calling the secretary a liar. So being the secretary told her what I SD, one the same grounds, why would she believe a liar. And if it is the case that she believes the secretary, then that would make her a liar for saying
