I am in the process of creating a video of illegal street racing which I plan to sell via my street racing web site. I am curious about the legal issues associated with selling such a video. For example, can me or anyone else on the video be prosecuted after the fact for a moving violation caught on video? Is there a particular disclaimer that I can use to protect the subjects on my video? Does anybody know what I can and can't do? Thank you for your input.

My response:

Just going from the way you describe this endeavor, I see no laws being broken by you. You have the right to video anything you like; i.e., you're not resposible for someone else breaking the law. Insofar as selling or showing the video, you need to "blot out" license plate numbers, and faces if you have not received a signed release from the persons in the video - - and I can't imagine that you would, either, because that would be evidence that law enforcement could use against the drivers.
