I am a resident in the state of Maryland and a new home owner in a townhouse community which has a HOA. My car was towed while parked in my reserved parking spot. The reason was because my tags had expired in November and my car was towed on December 2nd. The problem i have with this is that the bi-laws given to me upon moving inot this community clearly states that a car with expired tags will be ticketed and if not move within 48 hours will be towed at the owners expense. When I went to pick up my car from the towing lot I discovered that my car was not issued a ticket nor was i given 48 hours notice that my tags were expired. subsequently the Home owners association revised the towing policy, deleting the line which says that a car would be ticketed and if not removed within 48 hours would be towed, to any vehcile with expired tags will be towed.
I filed suit in small claims for the towing fees i had to pay plus a day of lost pay. Do I have a case that I can win? Or am i wasting my time trying to fight this?
