The MSA states that:
(Petitioner Name) transfers to (Respondents Name) as sole and seperate property, and (Petioners Name) is divested of all right, title, and interest in and to the following property:
Vehicle. The vehicle described as a (Insert Model) with vehicle identification number (Insert Vin) together with all prepaid insurance, keys, and title documents valued at ($$$). The property has a lien against it payable to (Insert Lien Holder) with loan number (xxxx), with a balance of ($$$).
My question is this, my ex has had the car repossessed, which she got back, and has been consistently late since I was separated. The way that I read the above statement she should have refinanced the vehicle to have my name removed and now my credit is suffering a great bit. Would filing a motion with the court to have her refinance it or be placed in contempt do me any good. I have gone as far as asked her for the car back so I can make the payments and try to sell it but she won't return it to me so now I have to resort to the courts. Will this even do me any good.
