My ex-boyfriend and I are in a legal battle over my daughter. We broke up and he told me to go to Alabama (my home of residence) with our daughter. Upon arrival I find out he filed a petition stating that I left without permission. After a few weeks I was served with the papers to show just cause. I consulted with an lawyer(and $3000 later)about who had jurisdiction. He claimed Alabama did. He was wrong. I went to court and the "fill-in" judge awarded us joint custody and my ex the physical custody!! The judge thought I was being devious and tried to take our daughter away from her father. He did not allow any merits to be discussed. The case was over in 4 minutes. Now that My ex has her he wont allow me to see her on any of my 4 visitation days. He has also filed a restraining order against me, allegations untrue!! This forces me and my son (previous marriage) out of the house. In light of all of this what can I do? False allegations, withholding my daughter, devious doings. He is not a good parent and I have tons of proof. The law guardian agrees as much as she is allowed to. How do I fight the restraining order and how can I get my daughter back? We still have a final court date coming up. How do I survive knowing my daughter is in an unsafe environment? Please help!
