I have full legal custody but the mother still wont give his records. I need my sons birth certificate or shot records to get a new one ASAP. We are going to court on Sep 13 for visitation for his mother, but I need it now. can I file an OSC Ex-Parte to get it now? Will this upset the next judge?

You can get a copy of his birth certificate directly from the vital records department in the state where he was born. You can get a copy of his shot records directly from his doctor. Why not just bypass the mother entirely since she is not being cooperative?

In order to get an ex parte from the judge you have to have a very good reason to interupt time with the judge. He will most likely think "Get the stuff yourself, don't depend on the mother." Just saying from A LOT of experience. Sorry for the difficult mother.

If you know anywhere these records are on file, request a copy in writing, and send a copy of proof who you are . For schools site the Federal Law giving you the right to them , and send a copy of Joint Custody, and state you have not been bared by any court order from obtaining them .

i didn't even know my sons doctor but his mother slipped up and sent a bottle of medicine with him. I called the doctor on the bottle and got a copy of his immunizations. He is only 2. Can I get a birth certificate with only his shot records? I am not on the birth certificate. Paternity has been established. Will the court have a record of my DNA test?

didn't you get anything from the company that performed the DNA test showing that you are the father? Didn't the court proclaim in legal documents that you have been found the father through DNA testing? If so, that should prove as evidence. Also, try the links to see if they even need proof and if so, what type of proof.
