I have a couple of questions that I pray someone here can answer quickly, as I will explain below. First off, I guess I should explain the situation.
I was arrested last Sunday night for possession of class 2 (Morphine). Luckily, they were my own perscription and the charge was dropped once they spoke to my doctor.
Because of the ammount of pills I had, they set my bond extremely high - 28,000.
This is where the problem started.
My sister-in-law's ex-boyfriend had a Nigerian check that he recieved. He promised my husband the 2800$ cash it would take to bond me out the day after I went to jail. Of course, everyone knows what those Nigerian checks are, and my husband got picked up on "criminal responsibility for another". They did NOT cash the check, but sister-in-law's ex attempted to and I guess Josh was considered a getaway driver or something similar.
Does anyone know what class felony/misdemeanor that is here in TN?
My husband's bond is a VERY high 50,000$, but the charge doesnt seem that serious.
My husband is a big pushover softy, a preacher's son, never even got a detention in high school so jail is *not* a very safe place for him. I haven't spoken to him because we are unable to accept collect calls from the jail. We have managed to find out, though, that my husband didn't have the sense to ask for a public defender! Our income is just my SSI, he has no job since he recently graduated, so he definately qualifies.
My other question, and I guess the most important one, is this:
Can I contact the district attourney, explain the situation, and ask if they would consider offering him a deal on his court date, Tuesday? I know he will gladly take probation if they will offer it to him, but being unsure what class felony/misdemeanor it is, I can't do any research. I'm finding NOTHING on the internet to help me out, and right now I'm the only one who can help him.
Worst case scenario, would I be able to *try* to represent him, so I can speak with the DA on his behalf?
I'm a lost duck in high water at this point, and I would appreciate any information ANYONE can give me.
