sorry, i just found the new post list. how does a father awarded sole physical and legal custody get medical info. The NCP mother will not hand over the shot records, ss#, insurance/doctor info

would that be small claims court since the shot records belong to the child? can it be stealing? He mostly wants the shot records because she can do a lot w/it like take the child out of state, illegally enroll him in school, the father needs the shot record to change baby's name

My response:

No. The court with Jurisdiction is the original Family Law court where custody was awarded to him.

Shot records are also given to day care and schools. As you can prove legal custody, perhaps you can contact anyplace (camps, schools, day care) your child attended and simply get a copy of at least the immunization records from them?

Having lived with the fact that I will never have a full and complete medical history of my child's first two years, I understand your frustration. However, It IS possible to determine if the child has acquired immunities (from shots or exposure) via a test when blood is drawn. Many of us used such a test on our orphanage kids when they came here, as we were uncertain of both the reliability of the foriegn records and the quality and storage of any immunizations they did recieve. Mine was reimunized for a couple things to be certain.

How to get Medical and Educational Records

Just go to the FERPA website. It tells you how to get both. As long as you know the school that the child attended and the doctor he saw. They even have a letter that you can print already typed up. That is how we got all my step-kids records. As long as there is no court order barring you from them, all you need is a birth certificate to get them. Good luck!

The child is almost two and has not attended school. the mother and I split up before I knew she was pregnant and only told me of his existance at 3 months old. i got custody after she kept leaving him w/me for months while i was paying her child support and she was on welfare. She wont even tell me where he was born. Is all of this info in the original court file?

Checking birth records

I would say check the birth records of the county she lived in when she first contacted you. She may not have even had him to the doctor for shots or anything else if he was always with you.

That's the age I got my daughter. We did a number of immunizations that would normally be done earlier.

If you can't find or get records, there may not have been any immunizations. Consider not wasting time with court. Your kid MAY need those shots, and if so, they need them NOW, not tomorrow!!!!! Get them to their doctor NOW . If your ped doesn't know about testing for immunities for kids with unknown medical histories and immunities, try contacting a Doctor that specializes in dealing with international adoptees. They know about caring for kids with no or unreliable medical histories.
