What is the name of your state (only U.S. law)? Indiana

I'm in need of some advice. I am the father of 2 children and have visitation with my children that I have been fighting to obtain full custody for over 3 years now.

I just found out yesterday the mother of my 2 children is dating a man who just recently went on the Indiana's Most Wanted list for a warrant for his arrest for possession of marijuana. He has been at her place off and on lately more than usual. I believe it's due to him knowing he's got a warrant out for him.

I've got court this coming Tuesday for a review on my case since school is going to begin for my children. I need some advice on what I should do or what I can do.

Ok...are you talking about the "Channel 6 most wanted list" or an actual law enforcement wanted list? Because nobody is going on a law enforcement most wanted list for possession of marijuana.

What kind of review are you talking about? A custody review?, a child support review? Do you have an attorney? Have you discussed this with your attorney.

You would have to prove that the boyfriend is a danger to your children for it to be a serious consideration. However, you could also turn him in on the warrant.

You can start with:

1. What does your current custody order say?

2. What do you want to change it to?

3. What change of circumstances is there in the children's life that justifies a custody hearing?

4. What proof do you have that it is better for the kids to be with you than with Mom (hint: rumors that Mom might have a boyfriend with a marijuana arrest or warrant will not be sufficient). How are the kids in danger? For that matter, is the guy even around when the kids are there?

How do you know that he's been at her place, and if he is "wanted" by the law, and you saw him there, why didn't you notify law enforcement?

It's a prior conviction that he has a warrant for. Also i've looked up the court public records on him and his warrant was active as of 7/13/2011 for violation of probation with probable cause.

Yes I can confirm he's been at the mother of my children's house. My children tell me that he's there and his sister has also confirmed that he's been there. He is having a child with her which she is due within days. So he's been over there more often because of that as well.

As far as the review it's due to the children are going back to school and the judge is going to determine how my visitation is going to resume because of it. I've had my children 186 over nights throughout the year as well as her. With them going back to school I will be getting cut down on my visitation with them because of distance.

But my question is since the felon is over at her house and they have been together for over 3 years she would know that he has a warrant as well. So wouldn't she be harboring a criminal? Isn't that punishable as well? Also isn't that grounds for change of custody.

I'm also concerned that since he violated probation for the possession charge, I'm worried that he has done drugs over at her house and maybe she has done them as well. Yes he has been around my children, I can confirm that as well. Just what he does around them I don't know.

Last note he has been reported to the police for his whereabouts but they have still yet to go pick him up.

Where did you look up the court records? At the courthouse?

If they have been together for three years and this is the first time you are griping about it, that ship has sailed.

Anything you cannot prove, you cannot use.

Then the police don't consider his warrant to be particularly serious.

So you not only want to take over custody of your kids, but you also want to put the pregnant mother of your children in prison?

I'm betting none of that won't happen if the police won't even bother to go pick him up despite numerous calls from you. (OK so I'm guessing that you made numerous calls:rolleyes:)
