What is the name of your state (only U.S. law)? New York.

Is using the USPS to send someone in another state a picture of yourself holding a gun a criminal act?

How about over the internet?

I would imagine it is, but then again I have had numerous esteemed posters state that sending someone a dead rat is not a crime, so this is why I ask.

Depends on what your motive would be. Generally it's not illegal but if you mean it as a threat, it can be a crime.

How is the person receiving it going to perceive it?

The person who received it felt it was a minor threat, but prefers to take no action.

It was a messy divorce. No DV or anything. He just seems to get reminded every few months to send her something to show her he is a tough guy.

Have her send back a picture of herself and her lawyer holding the picture of him holding a gun.

THAT sort of intimidation is legal.
