About 6 months back AT&T charged my CC for closing my internet and landline phone account. They said it was an early termination fee. There is no such fee mentioned anywhere on the website where I signed up or in my confirmation email (which was a joke). They screwed up my order and my bill several times so I finally gave up and cancelled the account. I disputed the $150 account on my CC and won so AT&T sold my account to a collection agency who sold it to another agency who is now reporting this to all 3 credit bureaus. How do I prove I don't owe something or is the burden on them to prove I agreed to it?
I have filed a dispute with the credit bureaus and am waiting to hear back.
My last question is what can I do about the current collector who has never sent me a single bill but then reported to all the bureas...isn't that against Fair Reporting Act?

Thanks in advance for any help.

Your best bet would have been to settle the account, then try and recoup any fees back through civil proceedings. Yes, you can contact the collection agency and explain to them that the account was settled. They should clear it off the records but it will be up to you to contact all the individual credit reporting agencies to clear this off the record.

Good luck.

Even if its not a valid charge? Don't they need to prove I agreed to the terms? I thought it was the agency's responsibility to remove the negative report.
Ugh AT&T charged me wrong for every single month. I was already out $44 in overcharges which is why I would never have settled and try to clear it up.

Thanks for your help.

Sure they would, in court. The collection agency doesn't have to provide you that proof. You can ask, but they don't have to. All they are required to do by law is provide a statement from the original creditor that the debt is valid.

Have you followed the standard procedure for disputing an item on your credit report?

I strongly suspect you are incorrect that you never agreed to a fee. You may have chosen not to read the full terms and conditions, but you agreed to them.

Ive checked the terms over several times. Its not there and I do know to read these things very carefully. It even advertises

"Look at what you get:

$14.95/mo. for a full 12 months with no term commitment."

which is what made my CC side with me.

I have reported the inaccuracies to each bureaus and I called the collection agency yesterday. The CA said they'd bounce it back to AT&T and remove it from my credit. Time will tell if they do.
