In 2013 I purchased a new construction from a big box builder. About 1/3rd of my property backs up to a pond with the rest I believed backed up to my neighbors.
Recently, my neighbors behind me moved and their boundaries were remarked showing that I had way more yard than I though, about a foot back. I decided to dig up my servery and compare it to the maps and found that my initial property line marked by the builders with flags was WAY off. I have a lot less property than I was told. AND my sprinkler heads have been installed on HOA property.
To put this into prospective. There is a drain and I was told that the entire drain was on my property and from the farthest right corner of that square drain to the bank of the pond was mine. I was told that the HOA had access to the pond and the drain but it was my property and I was responsible to maintain it. Come to find out none of the hill or the drain are on my property.
The issue I am having is:
1. This is a rather large piece of property that needs to be resodded due to grub worms. (They come from the grass on the bank that is not mine nor did I ever think was mine. It's always been a battle there with my grass.)
2. I have maintained, resoded, and watered this piece for 5 years now.
3. The builder sold me land that did not belong to me. At the time the pond on this end was empty and the boundaries seemed to match to the survey. Now that the pond has filled I am loosing a lot of my lawn.
4. My sprinkler heads are on HOA property, the were installed by the builder who told me this was my property.
If this is not my land I shouldn't have to pay for the maintenance and watering. And since this is a builder error shouldn't the builder fix this? My HOA says I have to maintain my embankment but says nothing about a large triangle of land between 3 property.
To further clarify, there is a large triangle between my property and my back yard neighbors and the pond. I was told it was mine, I found out none of is mine. Now I don't know what to do.
