What legal options do i have if i have a bug and rodent infestation in my apartment? We live on the second floor in a three floor building with twelve apartments and have been there since May 2009. We have had a roach infestation since before we moved in, we noticed them when we were moving our things in. We notified management at that point so they were aware, a few months later they sprayed all the apartments on the second floor, no other floor. We had no roaches for a few days and then they came back twice as hard. I called management and notified them again, a few weeks later they sprayed again. Well in three months the apartment as been sprayed twice and the roaches are still here. I went down to the apartment office and notified them of the situation and that nothing has helped...they notified me that they evicted a tenant on the third floor because of the filth in their apartment and that's where the roaches are from. I asked them what are they going to do about the roach situation, since we aren't the only ones with the problem, and they said that it was our responsiblity to get rid of them...they don't plan on spraying for at least three months. Tonight we came home and there was a mouse running across our living room. We don't know what to do...we deep clean the apartment once a week (under the microwave, behind the fridge, etc. ), wipe down everything everyday, wash dirty dishes right after usage, no clutter where they could hide, and have used the products management recommends but to no avail.

We haven't brought anything in to bring the mouse in either. We don't go to garage sales or anything like that where we could pick one up. My husband is right now as I type, trying to locate a hole or something where the rodent could have come in. We have had a few other problems with the apartment complex as a whole, but not to the extent where we are looking for some sort of legal action.What is the name of your state (only U.S. law)?

Without the cooperation of the other tenants, there is very little the landlord can do to eliminate your rodent and insect problems. The landlord has an effective plan but it does little if the other tenants do not also help out by keeping clean homes. Keep doing what you are doing and do not re-use mice traps.

Management told me when i was in the office they want to do unannounced apartment checks (they do a check once a year to make sure that apartments aren't sustaining damage they aren't aware of) but they have to give notice 48 hours before entering an apartment because of the lease, so this alows individuals that don't clean to clean. The day before the yearly check, we watched a family take 5 garabage bags out to the dumpster (we think they were the tenants that were evicted, we haven't seen them in awhile). We also have seen a tenant dumpster dive, almost weekly and once my husband was on the balcony and the tenant asked him to help him move some furniture from the dumpster to his apartment.

BTW: We picked up those new mouse traps that are suppose to kill but you don't see or touch anything and baited them with peanut butter...i hope it will work.

Good luck, but the landlord cannot by law just make inspections without notifying tenants. Basically, their hands are tide. You need to find a better class of people to live next to.
