What is the name of your state? What is the name of your state? South Carolina. Here is the situation. My son is in process of divorcing his wife, whom he married in 1989. In 1982 my husband and I both agreed , that in the event of his death,he was now in his mid 40's, that our son would receive his retirement pension. We thought it would be a good thing, since we were both young, and our son would need this if something happened to both of us. My husband died in 1997, and our son started receiving his pension. His wife wants to claim it as his income. I say that it was a gift , from my late husband and me, before he even met her, and that not only is it a gift but an inheritance. Do we have a chance at proving that it was a gift and inheritance???
