Example:

If your spouse owes a serious amount of arrearages for child support, the government may seize his/her tax refund to pay down those arrearages.
If you file jointly, your share of the refund could also be taken. However, if you fill out the injured spouse form, then the IRS will send you your portion of the refund, rather than allowing it to be seized.

So if there is a child tax credit taken for my child from a previous marriage, his child from a previous marriage and a child that we have together, how do they determine what of the total tax credit is 'mine' as opposed to 'his'? Also, how would they determine the child care tax credit taken for the same three children?

It is done on a percentage, based on how much of the income on the return is his, vs. how much is yours.
