currently my fiance is incarcerated for violation of probation his org. charge was assult and battery about four years ago I was told that INS has a hold on him and would like to know if he can be deported even though he has children that are U.S. citizens in addition to the fact that in november of this year we will be married while he is still incarcerated and I am a born US citizen can these things help him not to be deported?

I am afriad to say that he has problems.. Congress passed a law in 96 that basically gave the INS rights to deport anyone with a criminal record, especially if those charges are abuse, violence or drugs.

The fact that you are getting married while he is still in jail would not look to great either, they will assume he is doing it purposely to stay in the US. What visa did he enter the US on and how was he able to stay in the US ?

Basically, it will be tough for him to not be deported. He needs to see an immigration attorney.

On a personal note, why on earth would you want to marry someone who is in fail on assult and battery charges ?
