What is the name of your state (only U.S. law)? Texas
Can't help whom you fall in love with and I happen to fall in love with my fiance (whom I've been with for over 3 years now) who is not legally here in the country. While we have been to a lawyer in attempts of making him legal the laws currently we were not able to make him legal. Anyways so he is a hard worker and a student and he pays out of state tuition because of his illegal status. I read something about the hb 1403 law but I guess I dont understand it. He came to the country about 7 years ago and got his ged over 3 years ago, would he qualify for in-state tuition? p.s. Please just give legal advice, I dont need negative opinions or whatever. From what I read here (www.thecb.state.tx.us/reports/PDF/1528.PDF ) after tens seconds of searching, it appears that he qualifies for in state tuition.

House Bill 1403 granted certain non-immigrant students, including undocumented students, access to in-state tuition rates at Texas public institutions of higher education and state financial aid. To qualify, the bill required students to have:
  • resided in Texas with a parent or guardian while attending high school in Texas,
  • graduated from a public or private high school or received a GED in Texas,
  • resided in Texas for the three years leading to graduation or receipt of a GED, and
  • provided their institutions a signed affidavit indicating an intent to apply for permanent resident status as soon as able to do so.
The bill passed and was codified as Texas Education Code (TEC) 54.052(j).

While you MAY be right, I don't see specific information from the OP that would indicate that these conditions are met.

OP can always move with him back to his home country, where he can attend school and work legally. They can live happily ever after there.
